In reply to your email I am currently investigating 13 cases. I understand your concerns about the lack of prosecutions but ask you to bear in mind the problems there has been with the order and the time it takes to complete prosecution reports, large numbers of drivers have received written warnings since the order came into place.
With regard to the reduction in hgv`s breaching the order we base our information on our site enforcement visits, this Service had an Officer at Newbridge a couple of days ago and in 3 hours one possible breach was recorded compared when the order first came into force of 15 vehicles an hour, we have also had comments from residents whom report hgv`s to ourselves giving there opinion that overall the numbers have reduced.
With regard to your comments about vehicles using the route at night I will bring this matter to my manager’s attention with a view to night working at Newbridge.
I understand your frustration in this matter and assure you that Trading Standards takes the Breach of any Weight restrictions very seriously and will continue in its enforcement at Newbridge.

Thank you. So. I take it, there have been no prosecutions to date? I must say it is difficult to understand why not, given the time span involved. Perhaps you are able to tell us how many ‘pending’ investigations there are.
You do not say on what evidence you base your statement that the numbers of HGVs going over Newbridge has reduced; has a formal survey been carried out and, if so, may we see a copy of the results?
While unable to prove that they are actually crossing the bridge, though in reality there is no where else for them to go to or come from, many residents will testify that the number of HGVs using the Abingdon Road is increasing since the initial drop in numbers following the imposition of the weight limit. I understand that this is particularly true at night. This may not be surprising if no drivers have yet been successfully prosecuted.

Thank you for your email. The position regarding the pending investigations is that I am now at the stage to submit cases to Legal. As explained to the residents at Standlake the prosecution process can be quite time consuming and relies upon postal correspondence. I am working the cases in batches so that when they go to court it makes a greater impact and also receives better publicity.
Enforcement of the restriction is continuing and further operations are planned as the joint operations with the police seemed to have a great impact into the numbers breaching the Order. The numbers of hgvs going over Newbridge have reduced and will continue to reduce as enforcement continues.
When I have dates of cases in court I will let you know.

The Parish Council would also appreciate an update on the state of play regarding the level of enforcement and, importantly, an analysis of the number of reported violations, the number of prosecutions and the outcomes of those prosecutions since the erroneous closure order was amended. If you would e mail these to me so that I can present them at the next council meeting on 10th July I would be grateful. I would add to Luke’s comments that, while I do not travel via Newbridge very often, I can personally attest to the seemingly increasing number of HGVs heading through the village in that direction.
